Terms: Terms as quoted, shall apply. All orders C.O.D. We accept Visa and Master Card.

Conditions of Sale: All sales made by Water Perfect Products, Co. are subject to the conditions unless otherwise agreed to in writing by an authorized officer of the company.

Ordering: All prices are in US dollars. We accept orders by fax 480-641-0736, by internet, or toll free at 1-800-444-5033.
|
|
Prices: Prices, discounts, quotations and specifications are subject to change without notice and will be applied as in effect at time of shipment.
|
|
Shipments: All shipments are F.O.B. your warehouse on complete kits. Shipping is not included in parts sales. If overnight or 2nd day air is requested, there will be an additional charge.

|
Product Shortages: All claims for product shortages must be made within ten (10) days after receipt of merchandise. Fax your claim to Customer Service at 480-641-0736.

|
Freight Claims: All shipments must be inspected for freight damage, concealed or otherwise, prior to receipt of product. Damage must be noted on the freight bill and reported to Water Perfect Products, Co.
|
|
Taxes: Any Federal, sales, excise or similar tax for which we may be liable on any sale will be charged to and paid by the buyer. Buyer is responsible for furnishing a resale certificate prior to purchase.

|
Returns: Returns accepted only with RMA number. Call 1-800-444-5033 or authorization.

Warranty: EXPLANATION ON THE LIMITED TWO YEAR WARRANTY FOR THE AQUA-LEV

The Aqua-Lev is manufactured with high-grade materials under quality controlled manufacturing procedures. Every unit
is inspected before leaving the factory. It is warranted to be free of defects from workmanship and materials for
the period of TWO YEARS from the date of original purchase (proof of purchase required).
The ONLY LIABILITY of the manufacturer shall be to repair or replace the defective part. If the Aqua-Lev
becomes inoperative in the warranty period, a qualified service agent will evaluate the problem at the expense of
the pool owner. If he believes the Aqua-Lev is faulty he may contact Water
Perfect
Products Co. for warranty
authorization for the part replacement.
THE WARRANTY DOES NOT APPLY TO THE FOLLOWING:
- Where repairs have been attempted by unqualified persons.
- Failure resulting from excessive and unusual mineral content of supply water
- Damage from abuse or misuse from people, animals or from catastrophic occurences.
- Failure to function because of improper installation.
- Damage from excessive heat or freezing.
- Chlorinator damage (inline chlorinators).
- Damage caused by subsequent plumbing (other equipment installed after the Aqua-Lev).
- Replastering damage. (cement and sand damage).
- Failure caused by leaks in the circulation plumbing (EXAMPLE: pump, filter, pipes, pump basket lid, Jandy
Valves and filters, and any other components). Air leaks may cause the Aqua-Lev to not fill.
- Failure due to the malfunction of the electric time clock.
In no event shall Water Perfect Products Co.; Aqua-Lev Distributors and Dealers, be liable for any indirect,
incidental or consequential damages from the sale or use of this product. This disclaimer applies during and after
the term of warranty.
Under this warranty the manufacturer and their representatives disclaim liability for any implied warranty,
including implied warranty of "merchantability" and "fitness for a specific purpose".
This warranty provides the owner specific legal rights, and there may be also other rights which vary from state
to state. Some states do not allow the exclusion or the limitation of incidental or consequential damages so that
the above may not apply in certain states. Other states do not have all of the above limitations on how long an implied
warranty lasts, so all of the above limitations may not be applicable. |
